Moving border sprites into visible area does bring it closer to PAL original. If that means to swap upper and lower sprites, it is accepted by the fixing rules.
In this case moving upper sprites a few pixels down would do but might cause side-effects which require some recoding, indeed. Noone said NTSC fixing is an easy task. ;-)

Getting a game to work on NTSC at all, even with glitches, is 80s style NTSC fixing.
Getting it properly working as close to PAL as possbible is 90s and after. ;-)

It's fully playable, while the original doesn't run on NTSC at all. My aim was not to re-code the game completely. You are being picky and silly.

NTSC-Fix is incomplete.
Issues noticed:
- Bugs in map scrolling while showing level before playing.
- Upper border sprites partly invisible. NTSC fixing rules allow moving sprites from upper to lower border and vice versa because on NTSC upper border is too narrow to show full sprite height. Exchanging upper and lower sprites might be the solution here because lower sprites don't use full height.
