re-using existing tunes for new productions?

Hi,

general question related to the use of music in demos/intros:

I'm not exactly brand new to the C64 scene, but have been away for the better part of 30 years. What I remember from back then: it was considered bad taste to re-use already released music in new productions.

I've released a few graphics the last weeks, with additional small intro-like code and a tune to make it less boring to watch.

I don't consider myself skilled enough to make good music, and I don't actually like composing. Is there something like "public domain" music that I can use? If so, how does this work? If not, is re-using already released music ever done at all? (If so, how?)

Legal fineprint may differ, but i'm pretty sure that neither public domain of any sort nor the next best thing CC0 would effectively disallow things like using the work to promote fascism.

Like in the AI art discussion: copyright is a crude and outdated set of laws primariliy written on incentive of big companies. The aim of those laws was to protect those companies. Either from other companies or from the people. Often from authors. As such it is unfit to protect the authors who cry out for ethics and/or common decency. It seems to me that the only invocable part/section of the whole copyright package is “fair use”. People call upon copyright out of despair because nothing else with potential to protect their them exists at the moment. But something will have to change. We all need something else. New technology requires new legislation.
But I’m hijacking the subject, sorry.

Why not use https://deepsid.chordian.net to find a never used tune (e.g. via SID happens) and give a credit? Win-win.

OT Well, at least abroad, owners of the copyright successfully sued people, most prominent thing I recall is Down Under resulting in 5% royalties just because of the flute riff...

Bad about the example: The AUTHOR was long dead and buried, and once again it was a COMPANY (as pointed out above by 4gentE this is how Capitalism works in our world) that bought the rights just to sue someone...

BTT: In C64 scene there hardly ever _IS_ any money gained by the copyright criminal to sue him/her for ^^

yeah otherwise Euro-Dance (with all the samples and covers) would have been impossible or made lawyers very rich... no idea how this was dealt with in the US when Hip Hop came along...

I remember how Zombie Nation paid up to Whittaker. For one of Lazy Jones tunes used in Kernkraft 400. I think this was paid just to control the bad publicity damage, not out of fear of a lawsuit.

From a musician's point of view: I'm happy if one likes my music and wants to (re)use it in a production. All I'd like to ask is proper credit, and perhaps contact me and tell me you use one of my music. It's just good to know where it ends up being (re)used, and overall it's a good habit to communicate.

Well, sometimes you find a music which inspires you and then you use it. Like with this old intro, which I build around the music: Derrick Intro [atl+f4cg]
So nothing wrong with using existing musics for intros as long as credits are given - for larger demos I strongly recommend to team up with a musician for fresh music :-)
